Terms of Service Effective Date: August 6, 2026 These Terms of Service ("Terms") govern your access to and use of adaswift.com and related services offered by SwiftImpact Solutions ("Company," "we," "us"). By accessing or using AdaSwift, you agree to be bound by these Terms. 1. Services Description AdaSwift provides automated web accessibility auditing, scanning software, widget integrations, and marketing solutions designed to assist website owners in identifying and remediating digital accessibility barriers. 2. Account Registration & Responsibilities * You must be at least 18 years old and possess the legal authority to enter into binding contracts. * You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. * You agree to provide accurate, current, and complete registration and billing information. 3. Subscription Fees & Payments * Billing: Services are billed on a recurring subscription basis (monthly or annually) as selected at checkout. * Automatic Renewal: Subscriptions automatically renew unless canceled prior to the renewal date via your account dashboard or written notice to [email protected]. * Refund Policy: All fees are non-refundable except as expressly set forth in a separate written agreement or required by law. 4. License & Intellectual Property * Subject to compliance with these Terms, SwiftImpact Solutions grants you a limited, non-exclusive, non-transferable license to access and use the AdaSwift platform during your active subscription term. * All rights, title, and interest in and to AdaSwift, including code, architecture, design, domain names, and trademarks, remain the exclusive property of SwiftImpact Solutions. 5. Prohibited Conduct You agree not to: * Reverse engineer, decompile, or attempt to extract the source code of AdaSwift software. * Use the platform for any unlawful purpose or to scan domains for which you lack authorization. * Interfere with, overload, or compromise the security or integrity of our servers and network infrastructure. 6. Disclaimer of Warranties AdaSwift and its output are provided on an "AS IS" and "AS AVAILABLE" basis. SwiftImpact Solutions disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. 7. Limitation of Liability To the maximum extent permitted by law, SwiftImpact Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, revenue, or data, arising out of or related to your use of AdaSwift. Our total liability for any claim shall not exceed the amount paid by you to AdaSwift in the three (3) months preceding the event giving rise to the claim. 8. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. 9.
